The National Assembly Election Petitions Tribunal, situated in Enugu, has upheld the election victory of Senator Osita Ngwu, a member of the Peoples Democratic Party (PDP), representing Enugu West Senatorial Zone.
The tribunal's decision came as a blow to Dennis Oguerinwa Amadi, the Labour Party candidate, who had contested the election results, citing concerns with the electoral process.
The tribunal's ruling, issued on Tuesday, unveiled the critical flaw in the petitioner's case. Dennis Oguerinwa Amadi had merged allegations of non-compliance with the electoral act and corrupt practices in a single case. The tribunal emphasized that these allegations should have been presented as separate cases with specific supporting facts.
Regarding the allegation of over-voting, the tribunal noted that the petitioner failed to provide sufficient particulars in their pleadings, despite presenting witnesses and ballot papers as evidence. The court highlighted that the origin of the presented ballot papers remained unclear.
