Although I am not a lawyer, but I have elementary knowledge of law. When I heard the news that the Federal High Court, Abuja sacked the legally-encumbered governorship candidate of Labour Party in Enugu state, Bar. Chijioke Edeoga over the illegality of his emergence, I was not surprised.
I was not because I know that the circumstances surrounding Bar. Edeoga's emergence was questionable and illegal.
My worry over the judgment is the order by the court for the Labour Party to conduct another governorship primary within 14 days, when the date for all political parties' primaries and submission of candidates as enshrined in the electoral law has long elapsed.
Does it mean that the Judge was not conversant with the provisions of the 2022 Electoral Act as it concerns party primaries or he was just over-indulging the Labour Party illegally by the judgment?
I am wondering how Enugu Labour Party will be allowed to conduct another governorship primary outside the stipulated time for the conduct of parties primaries. Or does it mean that Enugu Labour Party will be operating a different law from the electoral act? I am just asking because I am confused.
Labour Party's failure to do the right thing at the right time on the Enugu governorship primary should not be treated with kid's gloves, not even by the court.
Labour Party erred in law in the conduct of its governorship primary in Enugu and should be punished accordingly without minding whose ox is gored. We have seen political parties including the ruling All Progressives Congress ( APC) having their primaries nullified and stopped from fielding candidates in the elections.
Enugu Labour Party should not be treated differently because ignorance is not an excuse in law. We are watching how it will pan out in the days ahead. But for now Edeoga is down and out.
